AI Policy Nextius Legal B.V.

Article 1 – Introduction

As a law firm, we value technological progress, provided it is in line with our core values: integrity, expertise and confidentiality. This AI policy provides insight into how we at Nextius Legal B.V. handle the use of artificial intelligence (AI) within our services.
Specifically, this AI policy covers:

• the purposes for which and the grounds on which we use AI;
• how we deploy AI in practice;
• confidentiality and data protection when using AI;
• transparency towards our clients regarding the use of AI;
• quality assurance.

Article 2 – Purpose and scope

This policy sets out the principles and safeguards governing the use of AI applications within our firm, in compliance with applicable laws and regulations, including the General Data Protection Regulation (GDPR), the Code of Conduct for Lawyers and (future) European regulations such as the AI Regulation.

Article 3 – Use of AI in practice

AI is used within our firm as a supporting tool for legal analysis, text formatting, internal process optimisation and risk assessments. AI never replaces the legal judgement of a solicitor. Every outcome relating to legal services produced with the aid of AI is assessed by a qualified solicitor for accuracy, relevance and applicability.

Article 4 – Responsibility and supervision

The use of AI always takes place under the strict supervision of the lawyer handling the case. Final responsibility for the content, quality and legal accuracy of all advice, procedural documents and other documents provided by us remains at all times with the lawyer handling the case.

Article 5 – Confidentiality and data protection

We do not process clients’ personal data or confidential information in open, publicly accessible AI systems. Where AI systems are used, this is done exclusively within secure environments that meet the highest standards in the field of information security and anonymisation.
Client data is only used in AI systems if:

• the processing takes place within a closed and controlled system, and
• the data has been processed in a pseudonymous or anonymous form, unless explicit consent has been obtained.

Article 6 – Quality assurance and continuous evaluation

We closely monitor technological and legal developments relating to AI and undergo continuous training. In addition, we periodically evaluate the use of AI within our firm and amend this policy if legislation, the state of the art or our professional rules give cause to do so.

Article 7 – Final provision

By applying this AI policy, we ensure that technological innovation goes hand in hand with legal diligence. Our clients can rest assured that the use of AI will never compromise the confidentiality, independence or quality of our services.
